dresden-events.com – Terms and Conditions of Use (updated: 01.01.2011)

1. These terms and conditions of use apply to the use of the services provided by dresden-events.com by individuals searching for events (users). dresden-events.com is an information portal belonging to Rank und Büttig Gastronomie GmbH, through which the users can access event information which Rank und Büttig or its contractual partners have placed on the portal. In this way, the dresden-events.com information portal provides users with information on selected events, free of charge.

2. Rank und Büttig Gastronomie GmbH accepts no liability vis-à-vis the user for the availability of the service and the accuracy and up-to-datedness of the event information. Rank und Büttig Gastronomie GmbH in particular assumes no liability for the accuracy and up-to-datedness of hyperlinks contained in event advertisements or for the content of the linked websites.

3. The event advertisements displayed on dresden-events.com reflect only that information published by the event organiser or as notified to Rank und Büttig. Rank und Büttig does not explicitly or conclusively check the material accuracy and legal admissibility. Rank und Büttig does not claim ownership of the contents of the event advertisements or of any other website to which these event advertisements refer.

4. Rank und Büttig Gastronomie GmbH will not, in the normal course of events, itself be the event organiser or vendor of admission tickets. When using any linked ticket service, the contractual arrangement will only be made between the ticket purchaser and ticket vendor. To the same extent Rank und Büttig does not assume any liability vis-à-vis the user for the accuracy, up-to-datedness and legitimacy of the contents of the linked websites. Excluded here from are the events offered by Rank und Büttig Gastronomie GmbH.

5. In relation to publication, Rank und Büttig Gastronomie GmbH, reserves the right to decide as to the selection, publication and deletion of the events to be published. There is no legal entitlement to publication of event notices. The terms and conditions of use may be amended at any time without any requirement to state reasons for doing so.

 

dresden-events.com – Terms and Conditions  Publication of events (updated: 01.01.2011)

1. Scope of application/Object of the agreement

1.1 The following conditions apply in relation to the event registration and publication service.
1.2 The dresden-events.com information portal is subject to these Terms and Conditions as well as the Terms and Conditions of Use.
1.3 The object of this service is the inclusion of an event/event notice in the event calendar of dresden-events.com, which belongs to Rank und Büttig Gastronomie GmbH.

2. User/Person making registration/cancellation

2.1 The use of the registration/publication service is available to natural and legal persons and is conditional on the free registration of a given event by means of the registration form. The user will be required to enter his/her/its name and email address as part of the registration. This information is necessary to identify the user and to apply a copyright label to a given event notice as well as to facilitate communication between the user and Rank und Büttig Gastronomie GmbH.
2.2 Rank und Büttig Gastronomie GmbH alone may decide as to the inclusion and publication of an event notice.
2.3 Both Rank und Büttig Gastronomie GmbH and the user are entitled to cancel the service for a given event notice/event with a notice period of two weeks. There is no requirement to state reasons. Event notices already entered will likewise be automatically deleted. The cancellation is to be communicated using dresden-events.com’s contact form or by sending an email to: events@dresden-events.com.

3. Conditions of use

3.1 By using dresden-events.com’s registration form the user may register an event notice for the events calendar, free of charge. In doing so, he/she/it may include an event location, website or an image alongside the mandatory information.
3.2 Rank und Büttig Gastronomie GmbH alone may decide as to the publication of a registered event. With regard to the publication, the user has no entitlement to require an entry to be made in a specific website section or at a specific location with specific text. Entries will be sorted according to date and, where stated, time of the event.
3.3 Rank und Büttig Gastronomie GmbH, as a rule, will not examine and monitor the registered event notices, but reserves the right, however, to adapt content published via the service. This applies in particular to content that infringes these terms and conditions and/or our publication guidelines or which are objectionable for any other reason. There is no legal obligation in this regard.
3.4 Following publication, the user may at any time submit additions or more detailed information concerning his/her/its event. The duration of the event notice starts with its inclusion (publication) on dresden-events.com and ends following the agreed publication time.

4. Rights assignment by the user

4.1 With the publication of an event notice on dresden-events.com the user grants Rank und Büttig Gastronomie GmbH a free, unlimited, geographically unrestricted, irrevocable, non-exclusive right, anywhere in the world and in whatever possible form, to (wholly or partially including the contents, e.g. the details page or images) use, reproduce, modify, adapt, publish, translate, edit, promulgate, list, present the entry and/or transfer the relevant event notice to other works (portals) until the notice is deleted, irrespective of whether these are currently known or are developed at some time in the future.

5. Rights and duties of the user

5.1 The user is solely responsible for the information and contents provided by it. Rank und Büttig Gastronomie GmbH does not claim any ownership of this material. The user must therefore ensure that his/her/its event notice does not infringe any third party rights. The user in particular guarantees that it holds the requisite rights of use in relation to the images it submits.
5.2 The user here and now indemnifies Rank und Büttig Gastronomie GmbH in relation to all third party claims asserted by way of a legal infringement based on or connected with an event notice registered by the user. This applies equally to the justifiable costs of legal counsel.
5.3 The user undertakes to observe the applicable laws of the Federal Republic of Germany.
5.4 The user has the right, at any time during the agreed term, to amend, modify or prematurely delete his/her/its event notice.

6. Rights of Rank und Büttig Gastronomie GmbH

6.1 Rank und Büttig Gastronomie GmbH reserves the right to reject or modify event notices without any requirement of stating its reasons. Any pending modifications will be coordinated with the user.
6.2 Rank und Büttig Gastronomie GmbH is entitled to use the other sites it operates to publish event notices registered by the user.

7. Fee

7.1 Event notices may be registered free of charge. The publication of an event notice will be in accordance with the current price list as may be amended from time to time.

8. Warranty/disclaimer

8.2 Rank und Büttig Gastronomie GmbH does not assume any liability regarding the particular number of event notice hits registered on dresden-events.com. No warranty, moreover, is given in relation to the user's event and the associated information. The user alone is responsible in these respects. Rank und Büttig Gastronomie GmbH does not assume any liability for any false information included in the event description.

9. Amendment of the terms and conditions

9.1 Rank und Büttig Gastronomie GmbH is entitled, at any time, to reorganise or amend the entry and publication service.
9.2 Provided it gives reasonable advance notice, Rank und Büttig Gastronomie GmbH is entitled, moreover, to amend or adapt the terms and conditions from time to time in order to satisfy legal requirements or to accommodate functions for changing its services. The amended terms and conditions will be sent to the user via the applicable email address. If the user fails to object to the new terms and conditions within four weeks of having received the email, these amended terms and conditions will be deemed accepted. If the user objects to the new terms and conditions within the stipulated period, the previous terms and conditions will continue to apply in this case. However in this case Rank und Büttig Gastronomie GmbH reserves the right to exercise an ordinary cancellation of the service for the user at the next possible point in time.
9.3 The information provided to the user via email will relate solely to those event notices published at the time of the relevant amendment to the terms and conditions.
